EU ruling hasn't derailed VistaJet livery trademark plans

After registering its red stripe on a silver fuselage private jet livery in the US, UK, and UAE, VistaJet says it continues its EU efforts.

Vista Global says its efforts to secure a trademark for its red stripe on a silver fuselage aircraft design, which Law360 reported was “dashed” by the EU last week, are part of an ongoing worldwide process to register the easy-to-spot livery that makes its VistaJet fleet stand out on the tarmac.

A spokesperson tells Private Jet Card Comparisons, “We have created the most iconic livery in business aviation. We implemented it consistently across a fleet worth billions of dollars. We have our own tag: #silverwitharedstripe. The livery is now part of the common vocabulary of every business aviation client. We wish to protect it as an integral part of our brand equity.”

She says, “The recent EU submission concerned a very narrow point of law. It does not mean the mark was rejected. It just means we need to continue the process and further tailor our application to align with the local approach.”

VistaJet livery trademarks

The Vista Global spokesperson says VistaJet has already successfully registered the design in several jurisdictions.

“We have already secured the trademark in important markets such as the U.S., the U.K., and the UAE,” she says.

The U.S. registration was filed in March 2022 and approved in May 2023.

It was filed in September 2022 and was registered a year later.

The spokesperson adds, “Every jurisdiction has slightly different requirements, and trademark offices have differing levels of expertise when it comes to business aviation livery. In fact, due to the novelty, none of the trademark offices we have dealt with have a designated category for this type of submission.”

That means “we continue to adapt our applications responding to how trademark offices are developing and establishing their practices on how to deal with such applications as we move along the process.”

The spokesperson says, “The protection for aircraft livery is a very new field, and in true VistaJet fashion, we are trailblazing here. Worldwide, there are only a handful of trademark applications for aircraft livery. That, and the fact that it has not been done before at a global level, introduces a layer of complexity.”
